Preserving
Diversity in Higher Education: A Manual on Admissions Policies
and Procedures After the University of Michigan Decisions
On
the anniversary of the U.S. Supreme Court's oral arguments in
the University of Michigan affirmative action cases, three leading
law firms made available Preserving Diversity in Higher Education:
A Manual on Admissions Policies and Procedures After the University
of Michigan Decisions, an innovative publication that provides
a clear, comprehensive legal interpretation of the Supreme Court
decisions to assist universities and law schools around the country
as they redraft their policies to comply with the 2003 high court
rulings.
The
200-page publication was researched and written by attorneys from
Bingham McCutchen LLP, Morrison & Foerster LLP, and Heller
Ehrman White & McAuliffe LLP.
Released
in two parts, the first sections of Preserving Diversity,
specifically delineating the legal framework for developing affirmative
action plans, were published on the EJS website in September 2003
on demand of several universities. The Manual in its entirety
- including legal analyses of financial aid, recruitment and scholarship
programs - was released on April 1, 2004 at the Equal Justice
Society's Third Annual National Conference at the University of
Michigan School of Law.
With
the generous support of a grant from the MK Level Playing Field
Institute, copies of the Manual were sent to the Dean or President,
Admissions Officer, and selected General Counsels at every accredited
law school (186 schools); every accredited medical school (141
schools); selected nursing schools; the top 50 universities and
the top 50 small colleges. Copies were also sent to 105 "affirmative
action advocates"-law professors who asked to be monitors
for their universities and over 100 national and regional higher
education policy and interest organizations. The Manual web page
has also received over ten thousand visits since April.
Media
coverage of the Manual's release has included reports in the Sacramento
Observer, Law.com, Americans for a Fair Chance, and the National
Association for College Admission Counseling. The Chronicle
of Higher Education, Black Issues in Higher Ed, and
Hispanic Outlook featured paid advertisements. Preserving
